Terms of Agreement
Terms of Agreement between: Japanese Knotweed Agency Ltd who’s registered office is at Hexagon Tower, Manchester, M9 8GQ. Hereinafter referred to as (JKWA). Company Registration Number 11641811; and; YOU (Introducer and / or Independent Surveyor)
DEFINITIONS
Introducer
Means the person receiving this agreement who is using the services of JKWA to create and manage the relationship with various other firms and Panel Solicitors
Recommended Customer
Means a Customer who fits the claim criteria and has been recommended our services by you, or a qualifying lead that generates a qualified customer.
Qualified Customer
Means a Customer who fits the claim criteria and the case is accepted by the Panel Solicitor through JKWA’s Network.
Panel Solicitor
Means the network of regulated Solicitors which JKWA recommends its Customers use to process their claim.
Recommendation Fee
Means the fee £200.00 - paid by JKWA to the Independent Surveyor / Introducer.
Accepted Case
Means a case which is accepted by a Panel Solicitor and the client instructs the solicitor to represent their JKW claim on a NO WIN NO FEE service.
Nothing in this Agreement shall compromise, infringe or impair any of the duties set out in the Code of Conduct nor allow the parties to influence or constrain the professional judgment of the Panel Solicitor in relation to advice given to the Court.
The parties acknowledge and agree that nothing in this Agreement will oblige (or be taken to oblige) them to make any (or any particular number of) recommendations to potential Customers.
It is acknowledged that JKWA and the introducer (hereinafter referred to as “The Parties”) will act in the capacity of Data Processor (as the term “Data Processor” is defined in the Data Protection Act 1998 (“the Act”)) in the performance of the Services. As Data Processor, the parties shall at all times perform the Services in such a matter as not to cause each other in any way to be in breach of the Act. At all times the parties will only process (as defined in the Act) and use the Data for the purposes of and duration of this Agreement
The parties shall ensure that all processing of Personal Data (as defined in the Act) under this Agreement is lawful and in particular the parties agree to comply with the obligations placed upon them by the Data Protection Principle in the Act.
Nothing in this Agreement shall create, or be deemed to create, a partnership or the relationship of employer and employee between the parties.
Each party agrees they are solely and entirely responsible for their own taxes and expenses.
Each party acknowledges that, in entering into this Agreement, it does not rely on any representation, warranty or other provision except as expressly provided herein and all conditions, warranties or other terms implied by statute or common law are hereby excluded to the fullest extent permitted by law.
This Agreement shall come into force on the day this email is received by you and subject as provided otherwise in this Agreement or by other notice shall continue in force until cancelled. A full copy of terms can be requested from JKWA.
Caution
Japanese Knotweed is ranked in the world’s Top 100 most invasive plant species. Every effort must be made to make sure there is no chance a surveyor being responsible for the spread or transfer of JKW to another site. With this in mind any contact with Japanese Knotweed is NOT acceptable and should be avoided.
